Time to regulate Internet gambling

Antigua and Barbuda -a tiny twin- island nation of 80,000 people in the Caribbean, is the mouse that roared on Internet gambling. It could force the elephantine United States to reconsider laws prohibiting online wagering with offshore casinos. Antigua challenged that prohibition before the World Trade Organization and won - twice. Congress should accept that reality and replace the ban with regulation designed to ensure the financial integrity of gaming in cyberspace, to screen out minors and to make sure that the United States gets its cut in taxes. Legislation introduced by Rep. Barney Frank provides a good jumping - off point for debate in Congress.

Antigua and Barbuda is home to 32 online casino operations. It initiated a trade complaint in 2003, claiming that the U.S. ban violates its rights as a member of the global free trade community policed by the WTO. It won in 2004 andagain in 2005, after the United States appealed: and the ruling was reaffirmed yet again this year. All that’s left is for the WTO to decide what damages to impose.

Time to regulate Internet gambling.

The organization’s credibility is on the line. It can’t risk the rap that it aggressively enforces trade rules against small nations but timidly allows the world’s economic powerhouse to skate. The integrity of the United States is also at issue. This country can’t respect trade rules that benefit us and ignore those that don’t without undermining valuable free trade agreements. Washington may be left with only two choices: Allow Americans to wager online with offshore casinos or ban all Internet gambling - including popular pastimes like fantasy sports leagues and off-track betting on horses, and maybe even the sale of lottery tickets online. Antigua argued that by permitting some online wagering while making it illegal for financial institutions to handle payments for Internet casinos abroad, the United States impermissibly discriminates against cyber-casinos. Washington should (must)respect the WTO ruling, permit Internet casino gambling and do all it can to protect American consumers.

Online Gambling Firms confident about its future prospects

PartyGaming- the world’s biggest online gaming company, has said that it is confident about its future prospects, despite the discontinuation of its US operations. The online gaming industry is ripe for consolidation once the barrier of retrospective legal action from US authorities has been removed and PartyGaming PLC is well-placed to be at the centre of such activity, according to its chief executive Mitch Garber.

Online Gambling site Bodog

Online gambling website Bodog.com was out of service Monday and remained inoperative Tuesday, apparently due to a $48.6-million default judgment obtained by a Las Vegas company against Bodog in a patent infringement case. By Tuesday afternoon, Bodog had established a new website, NewBodog, which is virtually identical to the old site and enabled Bodog clients to resume their online gambling activities.

In a news release issued late Tuesday, Bodog founder and part-time Vancouver resident Calvin Ayre, said “the problems result from a dispute over the ownership of the Bodog.com domain name.”

We are fighting this dispute and are confident that we will win,” he said in the release.

The release provided no details, but according to Nevada court documents, 1st Technology LLC of Las Vegas obtained a $48.6-million default judgement on June 14 against Bodog Entertainment Group S.A., Bodog.net and Bodog.com.

The Las Vegas company obtained the judgment after the Bodog companies failed to answer allegations, filed in U.S. District Court in Nevada, that downloaded software used by Bodog customers to facilitate its gaming activities infringed upon 1st Technology’s patents.

It is not clear why Bodog officials did not respond to the allegations. One possibility is they were scared away by the U.S. Department of Justice, which has declared war on Internet gambling.

Through a series of high profile arrests of online gambling executives, the Justice Department has made it clear that online gambling is illegal and anybody operating or facilitating such activities is subject to prosecution.

Since then, Ayre has avoided stepping on American soil, but he continues to return to Vancouver, where Bodog runs a marketing-support business in Vancouver called Riptown Media and a call centre in Burnaby called Triple Crown Customer Service.

Ayre was in Vancouver as recently as Friday, when he attended a Bodog-sponsored mixed martial arts fight night at the Chief Joe Mathias Centre in North Vancouver. The event is sold as a pay-per-view television event.

Meanwhile, 1st Technology has been steadily tightening the noose on Bodog, which was previously run out of Costa Rica but is now based in Antigua.

In an affidavit filed in conjunction with the court action, 1st Technology lawyer Kristopher Rath complained that, despite the default judgment, Bodog “continues to act with impunity in the United States.”

“The Bodog entities infringing activities are responsible for over $65 billion in cumulative transactions to date, with approximately two-thirds of this revenue currently being derived from infringing United States activities,” he said.

The lawyer noted that, according to a Forbes interview with Ayre, “Bodog handled $7.3 billion dollars of revenue which translates to over $4.8 billion in revenue in the United States with revenue growing 300 per cent per year since 2004.” He also noted that, according to the Forbes interview, Ayre “has amassed a current wealth of $1 billion, which was derived in large part through infringement of 1st Technology LLC’s patent.

“However, despite reaping the rewards of U.S. commerce, the Bodog entities evade United States law and courts, and Mr. Ayre gloats about his companies’ ability to operate above American law.”

The lawyer said 1st Technology “continues to suffer massive and irreparable harm because of the Bodog entities’ wrongful conduct”, and the “only way to stop this harm is to enjoin Bodog’s United States activities.”

In the early 1990s, Ayre got into trouble with the B.C. Securities Commission over his dealings with Bicer Medical Systems, listed on the former Vancouver Stock Exchange. In 1996, he admitted to serious offences in connection with that company and agreed to a 20-year ban from the B.C. securities market.

Brett Parise wins first leg in asia pacific poker tour

A 22-year-old university student from Indiana won the first leg of the inaugural PokerStars Asia-Pacific Poker Tour in Manila on Monday after three days of high-stakes gambling. Brett Parise win $180,000 in prize money and a place in December’s grand final in Sydney.

Parise, a student of political science and economics at the University of California, was the youngest player in the final nine. More than 200 players from 30 countries had started the three day event. Favorites Joseph Hachem, World Series of Poker champion in 2005, and Vanessa Rousso, one of the stars of the American poker circuit, were eliminated on the first day. Parise, who has been playing poker since he was 18, won his seat in the Asia Pacific Poker Tour (APPT) through a free online competition.

His mother, Jayne, said she did not know her son had won his trip to Manila “until he told me. I guess his dad will go with him to Sydney now.” All nine finalists shared a pool of $500,000 in prize money. Parise said he saw the game as a good way of making money but he doubted whether he would take it up full time. “I’ll finish my degree but I don’t have any idea what I will do after that. I like poker but it won’t be my life,” he said.

Tim Donaghy will overstate extent of betting

NBA officials say casual gambling exists among their ranks, but at the National Basketball Referees Foundation Conference this weekend, their main concern was that Tim Donaghy would exaggerate the extent of the gambling. One veteran referee at the conference, speaking on the condition of anonymity because the collective bargaining agreement prohibits officials from talking to the media without the NBA’s permission, said the topic of private discussions this weekend among the referees was that Donaghy would try to better his situation at their expense.

Gambling other than at a racetrack in the offseason is a violation of NBA rules for referees. Commissioner David Stern said Sunday that the referees need not worry about repercussions from Donaghy’s accusations.

Tim Donaghy will overstate extent of betting.

“Why would we believe anything he says?” Stern said. “What we’re going to do is give all 60 referees a chance to give us information about their activities, while legal, that violate our rules.”

Donaghy, an NBA referee for 13 years, has pleaded guilty to two felony gambling charges, including betting on games he officiated. He has said he will name at least 20 other referees who were involved in gambling activities.

South Africa plan taxation of internet gambling

Tax policy will be used to constrain the growth of internet gambling, says trade and industry acting deputy director-general Fungai Sibanda. He told Parliament’s trade and industry portfolio committee yesterday that this was the policy framework within which discussions were taking place between the trade and industry department and the treasury on the taxation ofonline gambling.

Many states try to prohibit online gambling because of characteristic dangers, including internet fraud, children’s access to gambling sites, a rise in gambling addiction and the need to preserve state revenue generated from legally enforced and state-run gambling operations. The absence of tax measures for internet gambling in the National Gambling Amendment Bill was a concern raised by the Casino Association of SA (Casa) during a public hearing this week.

Casa chairman Jabu Mabuza said the tax regime would be fundamental in determining the success of internet gambling and its consequences for bricks and mortar casino operations. Sibanda said the bill could not include tax measures as this was the remit of the treasury, which would have to introduce a separate money bill.

*The level and rate of tax will be determined by the policy approach which will be motivated by a desire to cap and limit the expansion of gambling. Taxation is a powerful instrument to control gambling activities.*

South Africa plan taxation of internet gambling.

Sibanda said studies on internet gambling provided no convincing proof that existing casinos had been affected negatively by interactive gambling. Casinos in SA were profitable and required no protection. Sibanda rejected suggestions to give casino operators the automatic right to operate interactive gambling, saying the two activities required different licences. Automatic licensing was in principle a bad idea.

He rejected criticisms that the bill was poorly researched and hastily drafted. It had been under consideration and widely consulted on since 2005, when a committee was established to formulate a policy approach on regulating internet gambling. Further investigation was needed on whether to allow person-to-person gambling or tighten restrictions on access of minors to internet gambling. The bill prohibits anyone other than bookmakers from providing player-to-player gambling. UK-based internet sports betting and gaming company Betfair argued for inclusion of player-to- player gambling. It objected to the requirement that licensed providers locate all their interactive gambling equipment in SA. The Online Institute for Cyberspace Law and Policy estimated in 1998 that by the mid-2000s internet gambling would be worth at least $10bn a year.

Antigua And Barbuda Internet Gambling

A number of legal experts and observers in the United States say Washington is in a bind over its on-going online gambling dispute with Antigua and Barbuda. In statements issued here Thursday, many of them said if the United States complies with the World Trade Organization’s (WTO) ruling, the Legislature and the Bush administration would either have to reverse course and allow Americans to place bets online legally with offshore casinos or they would have to impose an “across-the-board” prohibition on all forms of Internet gambling.

These include the online purchase of lottery tickets, participation in Web-based pro-sports fantasy leagues and off-track wagering on horse racing. At the same time, the experts said if Washington does not comply with the WTO it would present “big problems of its own”.

“Think of this from the WTO’s point of view,” said Charles R. Nesson, a Harvard Law School professor, in a statement issued here.

“They’re this fledgling organisation dominated by a huge monster in the United States. People there must be scared out of their wits at the prospects of enforcing a ruling that would instantly galvanize public opinion in the United States against the WTO,” he said.

In April 2005, the WTO gave the United States one year to comply with its ruling. But despite its non-compliance, Washington said it has reviewed its laws and concluded that it has not contravened the laws.

The case is now before a WTO Dispute Settlement Body (DBS), which is charged with assessing damages.

Antigua and Barbuda is seeking $3.4 billion in compensation from the United States for its non-compliance.

If Washington refuses to accept the DBS ruling, Antigua and Barbuda has also asked the WTO to grant permission for Antiguans to violate intellectual property laws by allowing them to distribute copies of American music, movie and software products, among others.

“The stakes here are enormous,” Professor Nesson said, while Lode Van Den Hende, an international trade lawyer based in Brussels noted “Geneva is certainly buzzing about this case”.

Van Den Hende said one reason for the global interest in the case is its “David-and-Goliath aspect.”

He said other reasons for the dispute include the fact that the case is likely to serve as a “major precedent” in establishing rules of commerce in the new information age, as well as “that the US is not behaving as one would expect”.

“One day they’re out there saying how scandalous it is that China doesn’t respect WTO decisions. But then, the next day, there’s a dispute that doesn’t go their way and their attitude is: The decision is completely wrong, these judges don’t know what they’re doing, why should we comply?” he added.

Mark Mendel, a US trade lawyer, who is representing Antigua and Barbuda in the dispute, said the issue is not one of “forcing gambling on a population that has decided they don’t like it.

“This is the world’s biggest consumer and exporter of gambling services trying to prohibit a small country from developing its economy by offering these same services and we find that deeply hypocritical,” he added.

Just a few days after the UK was not-so-shocked to find that Bet365, an online gambling company, gave more than 150,000 pounds in contributions to Gordon Brown’s Labour Party, the US lobbying group, The American Gaming Association, released their reports that declared more than $900,000 was spent lobbying Washington politicians the first half of 2007. The American Gaming Association represents the majority of the major land based gambling companies in the US, such as Harrah’s Entertainment, Bally Technologies, and MGM -Mirage. There are fifty more gambling related companies that the group represents.

All lobby groups in the US are required by federal law to report their spending if their intentions are to influence the executive or legislative branches. It is unknown what the group has lobbied for, but the amount of money is so great that it makes the Christian lobby groups, who are often seen as the opposing force to gambling groups, seem like nothing.

Expansion of gambling in the US is the concern of the major groups Price was referring to. It is unknown whether the companies would like to see gambling expanded to the Internet, where there has been much heated debate over the past year. Last year it was speculated that land based groups were actually one of the forces behind the passing of the UIGEA, but this year it has been revealed that companies like MGM would be very interested in putting their brand online if the opportunity were to arise.

Ladies Only Event At The Bicycle Casino In Los Angeles

The daughter of poker legend Doyle Brunson, Pam Brunson, took home the title at the Ladies Only event at the Bicycle Casino in Los Angeles. As part of the *Legends of Poker* series that is currently ongoing and will culminate this weekend with the WPT Championship event, the Ladies event is in it’s second year as a charity fundraiser for the Susan G. Komen Foundation for breast-cancer research. The casino donated 15 percent of each $1000 buy-in to this cause and the 125 participants were given special treatment if they donated to the charity. Other pros in attendance were Karina Jett, Kathy Liebert and Bodog poker pro Evelyn Ng. As winner of the event, Pam gets an invitation to play in the televised WPT Ladies Night on Aug. 31.

Poker Players Alliance Changing Locations

The Poker Players Alliance broke the news today that it is both changing leadership and picking up and moving to Washington D.C. -the hub of where all of its efforts are concentrated.

PPA President Michael Bolcerek stepped down in order to stay with his family in San Francisco, where the organization is currently based. John Pappas, who has served as vice president of government affairs for the PPA since May and acted as an outside consultant before that, became the executive director of the PPA following Bolcerek’s resignation.

*This is the right time for me to step aside as we move the PPA operations to Washington, D.C.,* said Bolcerek. I am happy to have helped the cause of American poker players and expect to see continued success from the efforts of Senator Alfonse DAmato and our new executive director, John Pappas.

Moving the base of operations to Washington, D.C., will likely produce positive results for the organization, as it will be easier and faster to orchestrate lobbying efforts from such a centralized location. The move is especially significant considering that legislation regarding online poker that has grown legs recently. The proposals, H.R. 2046 and H.R. 2610, the brainchildren of Rep. Barney Frank (D-Mass.) and Rep. Robert Wexler (D-Fla.) are meant to help Internet poker become a regulated, rather than restricted, industry in the U.S.

*This is an exciting time for the PPA and our members,* said D’Amato. The PPA has become an influential force fighting for the rights of poker players to enjoy this game of skill. There is wide support and momentum in the U.S. Congress to enact sensible legislation to regulate online poker and provide the necessary safeguards to all players.     Donald Trump repeal of casino smoking ban

    Donald Trump wrote to Mayor Bob Levy and City Council President William Marsh on Wednesday calling on the city to repeal a partial casino smoking ban that he claims is scaring away business. In his two-page letter, Trump said gamblers are fleeing Atlantic City en masse for competing casinos in Pennsylvania, New York and Connecticut that don’t have smoking restrictions.

    “The negative impact of the city ordinance is even more than the mere loss of a large number of smoking patrons to Pennsylvania, New York and Connecticut casinos and the perhaps permanent decline in Atlantic City gaming revenue,” Trump wrote. “It also requires that each casino operator expend millions of dollars to enclose its gaming floor smoking areas with structures which will significantly obstruct the customary flow of gaming patron activity and at the same time look absolutely terrible.”

    Atlantic City’s partial ban, which took effect on April 15, limits smoking to no more than 25 percent of the gaming floor at the 11 casinos. Smoking is off-limits in the remaining 75 percent of the gaming space.

    Marsh said Wednesday evening he had not yet seen Trump’s letter but noted that the 75-25 smoking compromise was supported by the Casino Association of New Jersey, the gaming industry trade group that includes the three Trump casinos.

    “At this point, I think the 75-25 split is very favorable,” Marsh said. “That is something that the Casino Association supported along with the majority of the casinos. So at this point, I don’t know if Mr. Trump has additional information that we don’t have.” Levy, who also said Wednesday evening he had not yet seen Trump’s letter, stated that it would first be up to City Council to repeal the partial smoking ban. Only then would he have to decide whether to use his mayoral veto power.

    Tim Donaghy facing up to 25 years in prison

    Disgraced NBA referee Tim Donaghy did more than officiate a Raptors-Seattle game at the Air Canada Centre last March; he spent part of the day getting paid for providing betting information and picks to gambling associates. A two-count felony indictment against Donaghy handed up in United States district court New York says the 40-year-old former official “had a meeting with a co-conspirator in Toronto, Canada, and received a cash payment” on March 11, the same day he officiated a Raptors-SuperSonics game. It was one of two meetings outlined in the eight-page indictment between Donaghy and two co-conspirators.

    Donaghy pleaded guilty to two counts on the indictment yesterday and faces up to 25 years in U.S. prison for conspiracy to engage in wire fraud and transmitting betting information through interstate commerce.

    Donaghy began betting on NBA games  including ones he refereed  about four years ago.

    He is free on $250,000 (U.S.) bond and is to be sentenced Nov. 9. He faces a fine of up to $500,000 and is liable to pay at least $30,000 in restitution to the U.S. government. Donaghy, who resigned from the NBA in July after officiating for 13 years, told a Brooklyn federal court judge yesterday he is receiving psychiatric treatment for a gambling addiction and taking medication for anxiety and depression.

    Donaghy began betting on NBA games including ones he refereed about four years ago and began receiving payment for information he started passing on to bookmakers in December, 2006.

    Tax Online Gambling Instead Of Banning It

    U.S. Representatives Steve Israel and Pete King (R-NY) published an engaging editorial in the NewYork Post yesterday outlining why they are such staunch supporters to regulate and tax online poker and online gambling instead of banning it.

    Under Frank’s bill, online gambling would be licensed and regulated by the Financial Crimes Enforcement Network and exempt from the Unlawful Internet Gambling Enforcement Act (UIGEA). It would also be taxed. (Simply taxing Web betting would generate significant revenues that could be used for a variety of domestic priorities).

    US residents will always find ways to gamble online! (In the end -there is the question of how much we want government to be involved in our private lives: For many, playing poker with friends on the Internet is a way to unwind at the end of the day. Technology aside, Web gambling isn’t so different than the way Americans have relaxed and enjoyed the company of friends for decades)

    In Britain -where Internet gambling is legal and regulated, technology checks ensure that gamblers are of age and are not problem gamblers: watch lists work to prevent money-laundering.
